3. Liability
THE USER AGREES THAT, EXCEPT FOR DEATH AND PERSONAL INJURY ARISING FROM THE NEGLIGENCE OF THE DOCTOR WHO CUTTINGS ARCHIVE, THE DOCTOR WHO CUTTINGS ARCHIVE SHALL NOT BE LIABLE IN CONTRACT, TORT, NEGLIGENCE, STATUTORY DUTY OR OTHERWISE, FOR ANY LOSS OR DAMAGE WHATSOEVER ARISING FROM OR IN ANY WAY CONNECTED WITH THIS CONTRACT, INCLUDING WITHOUT LIMITATION, DAMAGE FOR LOSS OF BUSINESS, LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS (EVEN WHERE THE DOCTOR WHO CUTTINGS ARCHIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE).
4. Rights Granted/Rights Reserved
The Doctor Who Cuttings Archive provides the Information to the User solely for the personal purposes of the User and the User may download the Information onto only one computer hard drive for such purpose. The Information may not be used for any other purpose including, publication, reproduction, or transmission without the express written permission of The Doctor Who Cuttings Archive and any other relevent copyright holder subject to which the User may upload and/or send material derived from the Information or other material to The Doctor Who Cuttings Archive. By uploading or sending any material to The Doctor Who Cuttings Archive the User thereby grants to The Doctor Who Cuttings Archive the right to use such material or any part of it on this website and in any manner it may determine in its sole discretion. Furthermore, the User thereby waives all so-called moral rights or other such similar rights in such material.
5. The Web Site User acknowledges:

The User will indemnify and defend The Doctor Who Cuttings Archive against all claims, liability, damages, costs and expenses, including legal fees, arising out of a breach of this Contract or any use of the Information or the Web Site by the User. The User acknowledges that The Doctor Who Cuttings Archive has no control over the nature or content of information or programs transmitted or received by the User using the Web Site and that The Doctor Who Cuttings Archive does not examine in any way the use to which the User puts the Web Site. The User agrees to fully indemnify The Doctor Who Cuttings Archive against any claims or legal proceedings arising in connection with User's use of the Web Site which are brought or threatened against The Doctor Who Cuttings Archive by any other person.
8. Intellectual Property
The User acknowledges that all copyright, trade marks and all other intellectual property rights in the Information shall remain vested in The Doctor Who Cuttings Archive or the writer/original publisher of copyrighted material including BBC Television, BBC Worldwide Ltd., etc. The use of scanned images from newspapers and other publications is not intended to infringe the copyright invested in the writer/original publisher of that information. Copyright remains with the writer/original publisher of any information on this Web Site. Information will be removed forthwith if the copyright owners object to their presence on this Web Site.
9. Suspension and Termination
The Doctor Who Cuttings Archive shall have the right to immediately terminate this Contract and/or suspend the Web Site if the User commits a breach of these terms and conditions.
10. User Data
The Doctor Who Cuttings Archive reserves the right to include the namenand other relevant information relating to the User in a directory for the use of The Doctor Who Cuttings Archive, unless specifically requested by the User in writing not to do so.
11. Links
The Doctor Who Cuttings Archive is not necessarily affiliated with sites which may be linked to this site and is not responsible for their content ("Linked Sites"). The Linked Sites are for your convenience only and you access them at your own risk.
12. Changes to the Terms and Conditions
The Doctor Who Cuttings Archive reserves the right to change these terms and conditions from time to time by placing a note of such change in this file, and the User's continued use of the Web Site following notice of such change shall be deemed to be the User's acceptance of any such change. 13. Severability
Each provision of this Contract excluding or limiting liability shall be construed separately, applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances and shall remain in force notwithstanding the termination of this Contract.
14. No Waiver
No waiver by The Doctor Who Cuttings Archive shall be construed as a waiver of any proceeding or succeeding breach of any provision.
15. Choice of Law
This Contract shall be governed by English law and the parties hereby irrecoverably submit to the exclusive jurisdiction of the English Courts.

It's use here is in no way intended to contravene any copyright held by any other website or organisation. It's presence here is intended to guard this research based website, and it's owner, from the attentions of the litiginous, unfortunately a growing number of people in the modern world!
General comments on not for profit sites and links to third party sites from this site
This site is run on a not for profit basis, we do, however, link to some carefully chosen commercial sites of direct relevance to the content of this site, e.g. The BBC Shop, Radio Times and the sites of the various newspapers/magazines that the cuttings originate from.
The reasons for this are two fold, firstly we are aware that this site draws on resources from varous copyright holders, most notably the BBC, and we feel it is only right to help to send traffic in the direction of the organisations concerned. Secondly, we also hope that this fact will allow any copyright holders to appreciate the mutual benefit of this arrangement and they will allow the Cuttings Archive to continue as is.
Links to sites such as the BBC Shop are available in order to show our support for the BBC and the official merchandise they produce. Any monies accrued from this linkage are used strictly to help fund the maintenance of the Cuttings Archive - no profit is made from this arrangement by the webmaster of this site or by any other individual who may be involved with this site.
Further to the above we have endeavoured to make sure that none of the sites we link to are using any forms of gratuitous advertising. Where a site is covering merchandise and, for example, presents the covers of current books we feel that a link to a place where these books can be bought is a useful service. On the other hand, where a site is filling pages with adverts and banners we will reconsider their link and will, most likely, remove it from this site.
We make every effort to ensure that the content of other sites we link to is legal and suitable for all viewers. However, we accept no responsibility for the content of any third party site. Commercial Usage of images from this site
Images from this site have been used in the past without credit in certain genre magazines in articles relevant to Doctor Who. Whilst the cuttings presented on this site are copyright to the Radio Times and the other publications that originally published them they also represent an awful lot of work on the part of the webmaster of this site and others.
The use of these images without credit is considered by the webmaster to be ignoring, and taking for granted, that work. If any commercial publication took the time to search out a cutting, scan it and ready it for use on a page it would take time and some money. The use of images from this site in such a way saves a commercial publication a deal of time, effort and money. In return we ask that we are contacted and a small credit is given. The above would apply to printed as well as online media. We might otherwise come to the unfortunate conclusion that our work and goodwill in creating and maintaining this site is being taken for granted and effectively being abused!
The usage and reproduction of any original image from this site in a commercial publication is strictly prohibited unless that usage is in the way of promoting this site and it's content in, for example, a review article or as a link to this site.
